影视作品中吸烟镜头的限制问题涉及到表达自由与公共健康的价值冲突。公共健康的价值位阶高于表达自由。然而,当对表达自由的限制程度过高,以至于由此产生的成本超过了限制所能带来的公共健康收益时,吸烟镜头的存在可获容许。现行规范虽试图平衡二者的需求,但其缺乏清晰、可操作的审查标准与有效的惩戒机制,导致规制目标与实践效果之间存在落差。新兴媒体的发展加剧了这一挑战。通过借鉴国外的分级制度、健康警告政策和经济性限制措施,可以从四个方面完善对吸烟镜头的规制:一是细化判断吸烟镜头必要性的标准,设定量化底线;二是引入健康警示政策,强制播前播后禁烟广告的插入;三是建立经济性惩戒机制,对违反限制要求、吸烟镜头数量过多的影视制作方处以罚款或征收相关税费;四是构建专项分级制度,降低青少年接触吸烟镜头的机会。

Abstract:
The restriction of smoking scenes in audiovisual works involves a value conflict between freedom of expression and public health. The value of public health takes precedence over that of freedom of expression. However, when the restriction on freedom of expression is so severe that the resulting costs outweigh the public health benefits that the restriction can bring, the presence of smoking scenes may be permissible. Although current regulations aim to balance these competing interests, the lack of clear and operable review standards as well as effective enforcement mechanisms, has led to a structural disconnect between policy objectives and practical outcomes. The rise of new media fuels this challenge. By examining international practices, including content rating systems, health warning policies, and economic disincentives, China's regulatory approach to smoking scenes can be enhanced in four key areas. First, establish precise criteria for assessing the necessity of smoking depictions, backed by measurable baselines. Second, institute a health warning policy under which it shall be compulsory to broadcast anti-smoking announcements both before and after the program. Third, impose financial penalties, including fines or compensatory taxes, on production entities that exceed stipulated limits on smoking scenes. Fourth, implement a targeted rating tier specifically designed to limit youth access to smoking scenes.
