跨境数字艺术品交易中电子签名互认的制度困境与协调路径

摘 要:
随着NFT(非同质化代币)与数字艺术品市场的蓬勃发展,跨境数字艺术品交易已成为数字经济的重要组成部分。然而,电子签名作为跨境数字交易信任基础设施的核心,在不同法域尤其是内地与香港之间面临深刻的制度困境。本文简述数字艺术品交易的法律特征与电子签名的制度角色,指出数字艺术品交易中涉及电子签名的特殊问题,通过比较内地与香港跨境电子签名互认的法律框架,引出跨境数字艺术品交易中电子签名互认的制度困境,参考域外的法律,并在“一国两制”宪制框架与大湾区发展战略的背景下,提出构建大湾区统一信任框架、推进两地立法协同、建立跨境监管协调机制、深化数字身份认证整合与专门化争议解决机制五条协调路径。

Abstract:
With the rapid development of the NFT (Non-Fungible Token) and digital art market, cross-border digital artwork transactions have become an integral part of the digital economy. However, electronic signatures, as the cornerstone of the trust infrastructure underpinning cross-border digital transactions, face profound institutional challenges across different legal jurisdictions, particularly between Mainland China and Hong Kong. This article briefly examines the legal characteristics of digital artwork transactions and the institutional role of electronic signatures, before identifying the distinctive legal issues arising from electronic signatures in digital artwork transactions. Through a comparative analysis of the legal frameworks governing cross-border electronic signature mutual recognition in Mainland China and Hong Kong, this article highlights the institutional dilemmas inherent in cross-border digital artwork transactions. Drawing on comparative legal experience from foreign jurisdictions, and against the backdrop of the "One Country, Two Systems" constitutional framework and the development strategy for the Guangdong-Hong Kong-Macao Greater Bay Area, this article suggests five coordination pathways: establishing a unified Greater Bay Area trust framework; promoting legislative alignment between the two jurisdictions; building a cross-border regulatory coordination mechanism; deepening the integration of digital identity authentication; and developing a specialized dispute resolution mechanism.
