摘 要:
实践中,知识产权的救济措施堪称多元,它们分别在各自的领域、根据不同的侵权行为形态,为回应权利人的不同权利保护诉求,发挥着规范制订者所期许的特定功能。当知识产权权利人为避免权利损害的进一步发生或者防止既有侵权损害的进一步扩大时,禁令救济具有独特的优势,其之于知识产权预先保护的实效性和精准性是在紧急情事中其他救济措施所不可替代的。根据知识产权禁令面临事态的紧急程度、颁发程序的程序保障程度、实体证明的充分程度的强弱,知识产权禁令可以分为实质确定型知识产权禁令、暂时确定型知识产权禁令、临时认定型知识产权禁令。它们与英美法系的终局禁令、临时限制令、初步禁令既有源于比较法移植形成的对应,又有源自本土改造产生的差异。对于这样一致性与非一致性关系的认识和处理是当下司法实务中有效发挥知识产权禁令功能的关键。现代民事诉讼理论本质上是裁判理论。当下司法实践中知识产权禁令类型杂糅的现状带来了程序的同质化等诸多困扰,进而降低了知识产权的保护实效,同时浪费了司法资源。为此,以禁令效力为落脚点的类型化作业成为破题的关键。

Abstract:
In judicial practice, remedies for intellectual property rights are diverse. Within their respective scope of application and targeting different forms of infringement, such remedies perform specific functions intended by legislators to address the varied demands of right holders for intellectual property protection. Where intellectual property right holders seek to prevent further infringement or the aggravation of existing damages, injunctive relief boasts unique advantages. Its effectiveness and precision in the preemptive protection of intellectual property rights are irreplaceable by other remedies under urgent circumstances.In light of the urgency of the case, the procedural guarantee of the issuance process, and the sufficiency of substantive proof, intellectual property injunctions can be categorized into substantively definitive injunctions, preliminarily definitive injunctions, and provisionally determined injunctions. These categories correspond to permanent injunctions, temporary restraining orders and preliminary injunctions in the common law system as a result of comparative law transplantation, while meanwhile presenting differences derived from localized institutional adaptation. The accurate understanding and proper handling of such similarities and divergences constitute the key to giving full play to the function of intellectual property injunctions in current judicial practice.Modern civil procedure theory is essentially adjudication-oriented. The current confusion in the classification of intellectual property injunctions in judicial practice has led to problems such as procedural homogenization, which undermines the effectiveness of intellectual property protection and results in the waste of judicial resources. Accordingly, typological classification grounded on the legal effect of injunctions serves as the core solution to this dilemma.
