摘 要:
数字藏品作为新技术的产物,对现有法律制度构成了冲击。数字藏品因其“稀缺性”和“唯一性”具备了较强的金融属性,同时还因提供了一定的欣赏价值,具备文化商品属性。此外,数字藏品上存在着多元主体的权利关系,难以准确界定其法律属性。传统的法律规制路径多基于权利范式理论,因过分依赖属性的界定,在面对数字藏品复杂性特征时常常无法实现全面的规制效果。而以权力束理论为基础的规制逻辑,虽然能够解决数字藏品在不同场景下所面临的问题,却可能导致法律关系的无序拆分,进而引发对数字藏品规范的混乱。因此,对数字藏品的法律规制应当采取模块化思维的路径。在厘清数字藏品的法律边界的同时,对其所涉法律关系予以标准化拆分,以平衡数字藏品的相关属性和相关主体的利益。由此可以做出对数字藏品的全方位规制,构建更完善的数字藏品规制体系,促进数字藏品行业的有序发展。

Abstract:
Digital collectibles, as products of new technology, pose a challenge to existing legal systems. Due to their "scarcity" and "uniqueness," digital collectibles possess strong financial attributes and also exhibit cultural commodity attributes due to their appreciation value. Additionally, the presence of multiple stakeholders creates complex rights relationships, making it difficult to accurately define their legal status. Traditional legal regulation paths are largely based on rights-oriented paradigms, which tend to overly rely on the identification of attributes. This approach often fails to achieve comprehensive regulatory effectiveness in the face of the complexities of digital collectibles.Although the regulatory logic based on power bundle theory can address the issues that digital collectibles face in various contexts, it may lead to disordered fragmentation of legal relationships, resulting in regulatory confusion regarding digital collectibles. Therefore, the legal regulation of digital collectibles should adopt a modular thinking approach. This involves clarifying the legal boundaries of digital collectibles while standardizing the legal relationships involved, thereby balancing the relevant attributes of digital collectibles with the interests of the involved parties.This holistic regulatory framework can facilitate a more robust regulatory system for digital collectibles, promoting the orderly development of the digital product industry.
