摘 要：
文化娱乐法体系建构是文化娱乐法研究的基础问题，一个文化娱乐法体系具备内部法律规范之间的逻辑性、独立性和自治性，应以文化产业作为自治领域，根据文化产业的“文化”和“产业”属性，建构体系，回应产业发展的现实需求，保证体系法的效力。具体的建构方案是：以宪法为根本，以法律和行政法规为法律规范的主要来源，从“文化”和“产业”两大维度，建构公私法混合型体系，实现文化产业法治功能。

Abstract:
The construction of a cultural and entertainment law system is a fundamental issue in the study of cultural and entertainment law. A cultural and entertainment law system should possess logicality, independence and autonomy among its internal legal norms. It should take the cultural industry as an autonomous domain and, based on the “cultural” and “industrial” attributes of the cultural industry, build a system to respond to the practical demands of industrial development and ensure the effectiveness of the system’s laws. The specific construction plan is: taking the Constitution as the foundation, with laws and administrative regulations as the main sources of legal norms, and from the two dimensions of “based on culture” and “based on industry”, build a mixed public and private law system to realize the rule of law function of the cultural industry.
